10.1LimitedWarranty—Europe
Termsandconditionsofthewarrantyarepartofthegeneraltermsandconditionsparticulartotheindividual
countriesinwhichthisproductissold.
InordertocomplywithHealth&SafetyregulationsandtoensurethatInvacareemployeesarenotexposed
totheriskofinfection,wemustinsistthatallproductsreturnedforrepairarethoroughlycleaned.Any
productsenttoInvacarewhichappearstobecontaminatedwillberejectedanddisposedofimmediatelyat
thecustomer’sexpense.
10.2LimitedWarranty—NorthAmerica
PLEASENOTE:THEWARRANTYBELOWHASBEENDRAFTEDTOCOMPLY
WITHFEDERALLAWAPPLICABLETOPRODUCTSMANUFACTUREDAFTER
JULY4,1975.
Thiswarrantyisextendedonlytotheoriginalpurchaser/userofourproducts.
Thiswarrantygivesyouspecificlegalrightsandyoumayalsohaveotherlegalrightswhichvaryfromstateto
state.
Invacarewarrantstheproductsmanufacturedtobefreefromdefectsinmaterialsandworkmanshipforaperiod
ofoneyearfromthedateofpurchase.Ifwithinsuchwarrantyperiodanysuchproductshallbeproventobe
defective,suchproductshallberepairedorreplaced,atInvacare’soption.Thiswarrantydoesnotincludeany
labororshippingchargesincurredinreplacementpartinstallationorrepairofanysuchproduct.Invacare’ssole
obligationandyourexclusiveremedyunderthiswarrantyshallbelimitedtosuchrepairand/orreplacement.
Forwarrantyservice,pleasecontactthedealerfromwhomyoupurchasedyourInvacareproduct.Intheevent
youdonotreceivesatisfactorywarrantyservice,pleasewritedirectlytoInvacareattheaddressontheback
cover,providedealer’sname,address,dateofpurchase,indicatenatureofthedefect.
InvacareCorporationwillissueaserializedreturnauthorization.ThedefectiveunitorpartsMUSTbereturned
forwarrantyinspectionusingtheserialnumber,whenapplicableasidentificationwithin30daysofreturn
authorizationdate.Donotreturnproductstoourfactorywithoutourpriorconsent.C.O.D.shipmentswillbe
refused;pleaseprepayshippingcharges.
LIMITATIONSANDEXCLUSIONS:THEFOREGOINGWARRANTYSHALLNOTAPPLYTOSERIAL
NUMBEREDPRODUCTSIFTHESERIALNUMBERHASBEENREMOVEDORDEFACED,PRODUCTS
SUBJECTEDTONEGLIGENCE,ACCIDENT,IMPROPEROPERATION,MAINTENANCEORSTORAGE,
PRODUCTSMODIFIEDWITHOUTINVACARE’SEXPRESSWRITTENCONSENT(INCLUDING,BUTNOT
LIMITEDTO,MODIFICATIONTHROUGHTHEUSEOFUNAUTHORIZEDPARTSORATTACHMENTS;
PRODUCTSDAMAGEDBYREASONOFREPAIRSMADETOANYCOMPONENTWITHOUTTHE
SPECIFICCONSENTOFINVACARE,ORTOAPRODUCTDAMAGEDBYCIRCUMSTANCESBEYOND
INVACARE’SCONTROL,ANDSUCHEVALUATIONWILLBESOLELYDETERMINEDBYINVACARE.THE
WARRANTYSHALLNOTAPPLYTOPROBLEMSARISINGFROMNORMALWEARORFAILURETO
ADHERETOTHEINSTRUCTIONSINTHISMANUAL.
THEFOREGOINGWARRANTYISEXCLUSIVEANDINLIEUOFANYOTHEREXPRESSWARRANTIES.
IMPLIEDWARRANTIES,IFANY,INCLUDINGTHEIMPLIEDWARRANTIESOFMERCHANTABILITY
ANDFITNESSFORAPARTICULARPURPOSE,SHALLNOTEXTENDBEYONDTHEDURATIONOF
THEEXPRESSEDWARRANTYPROVIDEDHEREINANDTHEREMEDYFORVIOLATIONSOFANY
IMPLIEDWARRANTYSHALLBELIMITEDTOREPAIRORREPLACEMENTOFTHEDEFECTIVEPRODUCT
PURSUANTTOTHETERMSCONTAINEDHEREIN.INVACARESHALLNOTBELIABLEFORANY
CONSEQUENTIALORINCIDENTALDAMAGESWHATSOEVER.
SOMESTATESDONOTALLOWEXCLUSIONORLIMITATIONOFINCIDENTALORCONSEQUENTIAL
DAMAGE,ORLIMITATIONONHOWLONGANIMPLIEDWARRANTYLASTS,SOTHEABOVE
EXCLUSIONSANDLIMITATIONSMAYNOTAPPLYTOYOU.
