Those portions of this Manual (including this part) containing Notices of Copyright, Warranty, Intellectual Property,

Trademark Information and legal cautions may not be altered, concealed or deleted by anyone without the explicit

consent of Megatel in writing.

The information contained in this Manual may be used only for the purposes permitted by and subject to license

Agreements contained in this document and in other product documentation, in Web-Site legal notices and in

Confidentiality Agreements governing the disclosure and use of this information. This Manual is provided to the User for

informational purposes only. The User may use a single copy of this Manual for their personal use only, and the User

may not reproduce, modify and create derivative works to this Manual without the written authorization of Megatel.

LIMITED WARRANTIES

Megatel makes no representation or warranty with respect to any circuitry or software not embedded within a Megatel

Product.

Megatel warrants that for a period of one (1) year, beginning on the date that Megatel ships a Megatel product, the then-

current documentation and specifications will materially conform to the Hardware and Software contained therein and will

operate in accordance with Megatel's published specifications and documentation for that product at the date it is

shipped, provided that the user’s sole remedy and Megatel's sole liability for breach of this warranty shall be to return

any defective Megatel Produce for replacement or repair or (if such replacement or repair is not economically feasible

then, at Megatel’s election) for credit to the User. The User is responsible for all costs associated with return freight and

insurance to (and from) Megatel's designated location.

This LIMITED WARRANTY is contingent upon the proper use of the product. The WARRANTY is void if repairs are

necessary due to accident, unusual physical, electrical or electro-magnetic stress, misuse, shipping or causes other than

ordinary use including causes due to any user-supplied BIOS or other software if applicable. The WARRANTY is also

void if the Hardware product has been modified or disassembled, or if the serial number label on the Product is altered or

removed, or if any repairs or modifications are attempted by anyone not authorized by Megatel, or if any physical

modification is made to the factory-set configuration if applicable, or if any modification is made to the physical board,

without prior written permission from Megatel.

EXCLUSIVE WARRANTIES

THE FOREGOING WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER

WARRANTIES, EXPRESS OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR

OTHERWISE INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE.

MEGATEL SHALL NOT BE LIABLE UNDER THIS WARRANTY IF THE ALLEGED DEFECT IN THE PRODUCT DOES

NOT EXIST OR WAS CAUSED BY USER'S OR ANY THIRD PERSON'S (FOR WHOM MEGATEL IS NOT

RESPONSIBLE AS PROVIDED HEREIN) MISUSE, NEGLECT, IMPROPER INSTALLATION OR TESTING,

UNAUTHORIZED ATTEMPTS TO REPAIR, OR ANY OTHER CAUSE BEYOND THE RANGE OF THE INTENDED

USE, OR BY ACCIDENT, FIRE, LIGHTNING OR OTHER HAZARD.

Megatel makes no Warranty or Representation about the accuracy of anything contained in this Manual, which is

provided to the User for informational purposes. The User shall make no claim in damages (including but not limited to

special, general, direct, indirect and consequential damages) or otherwise against Megatel arising from its use, or the

use by others, of this Manual.

Megatel Products are not designed for use in applications where they are relied upon for the protection and preservation

of human life, including such applications as control of aircraft, air traffic, aircraft navigation or aircraft communications

or in the design, construction, operation or maintenance of any nuclear facility, or in the operation or maintenance of any

direct life support system. The products may have such applications but the parties making such use should assure itself

that all safety concerns are addressed fully. Megatel disclaims any express or implied warranty of fitness for such uses

in the absence of Megatel’s specific undertaking in writing in that regard.
