been subjected to misuse, negligence or accident or other similar or dissimilar use.

CONSEQUENTIAL OR SPECIAL DAMAGES ARISING DIRECTLY OR INDIRECTLY OUT OF THE USE OF
THIS ITEM, NOTWITHSTANDING THE FACT THAT SAID INJURY, PROPERTY DAMAGE OR OTHER
