WARRANTY POLICY TERMS AND CONDITIONS

(Bendix Commercial Vehicle Systems LLC. and/or Bendix Spicer Foundation Brake
LLC.) warrants to the original retail purchaser of product sold by Company will be free from
defects in materials or workmanship for the warranty period shown in the tables. (Coverage
applies to New and Remanufactured product equally — unless noted otherwise.)
LABOR • Per the Warranty Policy terms listed (except for Hydraulic products), for the first twelve
(12) months, 100,000 miles (160,000 KM) or 3600 hours, whichever occurs first, Labor will be
reimbursed at the current labor rate applied to the standard hours allowed in the Removal
and Replacement Schedule (BW1322) when defective product is confirmed. This labor
reimbursement allowance is for the de-install/reinstall time only and does not allow for any
unusual or abnormal circumstances, excess time or diagnostic time involved.
This Limited Warranty Policy will not apply if, in the judgment of Bendix, the unit(s) or part(s)
thereof have been subjected to damage by abuse, neglect, misuse, road debris, accidents or
improper installation, maintenance or service, or use in non-standard vehicle applications that
have not been approved by Bendix or which do not meet Bendix specifications and guidelines,
or if Bendix serial numbers affixed to the product are removed, obliterated or defaced. The
liability under this Warranty Policy shall not exceed the purchase price paid. • Product claimed
to be defective must be returned, freight prepaid, via the Original Equipment (OE) dealership
or authorized Bendix Distributor within 30 days after the date any defect is first discovered.
Unauthorized repairs will void this limited warranty. (Unauthorized repairs include partial or
complete disassembly of any component unless otherwise stated. Approved repairs include
only replacement of air dryer purge valve, replacement of air dryer mounted governor,
replacement of compressor unloader valve.) • Bendix will inspect the product and make the
final determination as to whether the product is covered under this limited warranty. When
a warranty claim is allowed Bendix’ responsibility is limited, Bendix, at its option will issue
credit for the defective product at applicable remanufactured exchange price (when available).
Replacement unit will be warranted for the remaining time period, mileage or operation hours of
the original unit warranty. • This Warranty Policy is void if anything other than Genuine Bendix
Brand replacement parts are used. • Warranty of Bendix ABS components is valid only when
installed as part of a complete Bendix ABS System. • This Warranty Policy does not cover
claims for “serviceable” items such as filters, service diaphragms and desiccant cartridges
[Desiccant cartridge replacement allowed under this limited warranty only when contamination
of the cartridge is the result of a warranted failure upstream of the air dryer (e.g. oil passing
compressor)] or similar (but not limited to these) items unless there is a clear indication of
defect in material or workmanship. • This Warranty Policy does not cover normal wear and tear
to items including, but not limited to, pads, rotors, linings, guide pins. Boot damage resulting
from road hazard or use of improper replacement tools is not covered under this limited
warranty. Any damages resulting from the use of non-OE approved replacement components,
including brake pads, rotors or brake chambers are not covered under this limited warranty.
• This Warranty Policy does not cover Foundation Drum Brake bushings or any miscellaneous
hardware. Friction material has specific coverage as detailed in attached tables. • Product
parts and components manufactured by others, such as wheel seals or slack adjusters, are
warranted by their original manufacturers, and not by Bendix. • For warranty consideration
on Air Disc Brake Product, return the sets of pads from both ends of the affected axle clearly
marked with claim number and wheel position. • This Warranty Policy does not cover claims for
product where the failure is the result of a lack of service or lack of proper maintenance. • This
warranty Policy does not cover claims for air dryers where a non-Bendix
®
branded desiccant
cartridge, purge valve or replacement governor (where applicable) is used. • This Warranty
Policy does not cover claims where an OE-supplied PuraGuard
®
Oil Coalescing Cartridge
is replaced with a standard (non-oil coalescing) cartridge, even if genuine Bendix” branded.
• This Warranty Policy does not cover claims on air valves or hydraulic valves where evaluation
shows the ingestion of foreign material into the valve. This includes liquids, solid material and
alcohol-based products. • This Warranty Policy does not cover wires that are pinched during
installation or where wires are chafed or cut due to improper installation or where the wires have
been cut to remove from vehicle or where wires are not installed as recommended by Bendix.
THIS LIMITED WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES,
EXPRESSED OR IMPLIED, ARISING BY OPERATION OF LAW OR OTHERWISE,
INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR
A PARTICULAR PURPOSE, AND IN NO EVENT WILL BENDIX BE LIABLE FOR ANY
INDIRECT, SPECIAL, PROGRESSIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES,
INCLUDING, BUT NOT LIMITED TO, COSTS INCURRED FOR SERVICE CALLS, TOWING,
DOWN TIME, CARGO DAMAGE, OR ANY OTHER BUSINESS LOSS RESULTING FROM
FAILURE OR USE OF BENDIX PRODUCT. • INDIVIDUAL CUSTOMER AGREEMENTS MAY
SUPERSEDE COVERAGE PERIODS LISTED. • Bendix is not responsible for claims that are
not returned to Bendix within 90 days of the stated failure date. • For warranty consideration,
product claims must be returned freight prepaid via the (OE) dealership or authorized Bendix
distributor within 30 days after the date any defect is first discovered.
