shall be free from defects in workmanship and material for a period of twelve (12)
months after the sale of product to customer. In the event that within the above
mentioned warranty period, Cub confirms that a product
is defective; Cub will
replace theproduct at nocosttocustomer. If itis determinedthatthe producthas
beensubject to accident,misuseorabuse this warranty andthe limitedobligations
hereunderwillbevoid.THISISTHESOLEANDEXCLUSIVEWARRANTYANDLIABILITY
TO CUSTOMER. CUB EXPRESSLY
DISCLAIMS AND OTHER WARRANTY INLUDING THE
WARRANTIES OFMERCHANTIABILITY,FITNESS FOR PURPOSEOFOTHERIMPLIEDOR
EXPRESS WARRANTIES. UNDER NO CIRCUMSTANCES SHALL CUB BE LIABLE TO
CUSTOMER FOR ANIY OTHE AMOUNTS INCLUDING LABOR CHARGES FOR
INSTALLATION OR REINSTALLATION OF PRODUCTS NOR SHALL CUB LIABLE UNDER
ANYTHEORYFORANYOTHERDAMAGESINCLUDINGBUTNOTLIMITEDTODIRECTLY,
INDIRECT,SPECIAL,CONSEQUENTIALANDINCIDENTALDAMAGES.
