DANGER, INC. End-User License Agreement and Limited Warranty

PLEASE READ THIS AGREEMENT BEFORE YOU ACTIVATE YOUR SERVICES WITH T-MOBILE. ACTIVATING

THE SERVICES SHALL CONSTITUTE YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS.

DANGER END-USER LICENSE AGREEMENT and LIMITED WARRANTY

THANK YOU FOR PURCHASING THIS PERSONAL ELECTRONIC DEVICE (“DEVICE”) MANUFACTURED

THROUGH DANGER, INC. (“COMPANY”). PLEASE CAREFULLY READ THE FOLLOWING – IT DESCRIBES

THE TERMS AND CONDITIONS ON WHICH COMPANY OFFERS YOU USE OF THE DEVICE. ACTIVATING THE

SERVICES WILL CONSTITUTE YOUR ACCEPTANCE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT.

IF YOU DO NOT AGREE TO ABIDE BY ALL OF THE TERMS AND CONDITIONS CONTAINED IN THIS

AGREEMENT, YOU MUST NOT ACTIVATE THE SERVICES, INSTEAD, RETURN THE DEVICE TO THE PLACE

WHERE IT WAS PURCHASED.

A. General Information

You, the purchaser of the Device, shall be granted the license and right to use the software and

other technology embedded in the Device. Your use of the Device, and the use of the Device by any third party

authorized by you, is subject to the terms and conditions of this Agreement.

Risks Associated With Use.

Your access to Your personal computer, third party networks, wireless networks, and

Internet sites through use of the Device or any services accessed through the Device is solely at Your own risk.

Company does not warrant or guarantee the safety or reliability of any content or network You may access through

use of the Device.
