which it is installed. If the circuit breaker fails within the
warranty period because of a defect in material or work-
manship, Cutler-Hammer Inc. will replace the defective
breaker free of charge upon return to place of purchase.
II. BR Branch Circuit Breakers
Cutler-Hammer Inc. warrants its Type BR branch circuit
breaker to be free from defects in material and work-
manship under normal care and proper usage in a resi-
dential installation, for a period of 5 years from the date
of installation. The time period will be extended for 10
years if a functioning Cutler-Hammer surge/lightning
arrester is installed in the loadcenter. If the circuit
breaker fails within the warranty period because of a
defect in material or workmanship, Cutler-Hammer Inc.
will replace the defective breaker free of charge upon
return to place of purchase.
III. Additional Information
Notice requirements and limitations applicable to
Cutler-Hammer Inc. warranties are:
A. WARRANTY ONLY COVERS PURCHASES MADE IN
THE U.S. AND CANADA.
B. Cutler-Hammer Inc. must be given prompt notice of
any defect or failure of any product covered by the war-
ranty. Any warranties granted or liabilities assumed
hereunder will not apply to products that have been
damaged, altered, repaired or operated otherwise than
in conformity within the requirements for safe opera-
tion and maintenance.
C. THERE ARE NO OTHER WARRANTIES WHICH EX-
TEND BEYOND THOSE EXPRESSLY SET FORTH HEREIN.
CUTLER-HAMMER INC. DISCLAIMS ALL OTHER WAR-
RANTIES, INCLUDING WITHOUT LIMITATION, ANY
IMPLIED WARRANTY OF MERCHANTIBILITY OR OF FIT-
NESS FOR A PARTICULAR PURPOSE. CUTLER-HAM-
MER INC.’S OBLIGATIONS HEREUNDER ARE THE EX-
CLUSIVE REMEDY OF THE BUYER WITH RESPECT TO
THESE PRODUCTS, WHETHER IN CONTRACT, IN TORT
(INCLUDING NEGLIGENCE OR STRICT LIABILITY) OR
OTHERWISE. IN NO EVENT WILL CUTLER-HAMMER
INC. BE LIABLE FOR ANY OTHER DAMAGES, WHETHER
DIRECT, INCIDENTAL, CONSEQUENTIAL OR OTHERWISE.
D. With respect to products purchased by consumers
of the United States for personal use, the implied war-
ranties, including but not limited to the warranties of
merchantability and of fitness for a particular purpose,
are not excluded but are limited to the duration of the
applicable warranty period. Some states do not allow
limitations on the duration of an implied warranty, so
the above limitation may not apply to buyer. Similarly,
some states do not allow the exclusion or limitation of
incidental or consequential damages, so the above ex-
clusion or limitation may not apply to buyer. This war-
ranty gives buyer specific legal rights, and buyer may
also have other rights which may vary from state to state.
E. These warranties cover residential use of Cutler-Ham-
mer Inc. Type CH and BR products and exclude any com-
mercial applications.
F. All CH and BR loadcenter warranties are rendered
null and void if a breaker other than those specifically
listed on the Cutler-Hammer publication for use in that
panel are installed within the loadcenter.

II. Disjoncteurs de dérivation de type BR
Cutler-Hammer Inc. garantit son disjoncteur de
dérivation de type BR contre tout défaut de matériel ou
de main-d’oeuvre suite à un usage normal et à un
entretien adéquat dans une installation résidentielle,
pour une période de 5 ans à partir de la date d’installation.
Cette durée sera prolongée à 10 ans si un protecteur de
surtension/parafoudre Cutler-Hammer en bon état de
marche est installé dans le panneau de distribution. Si
le disjoncteur tombe en panne durant la période de
garantie en raison d’un défaut de matériel ou de main-
d’oeuvre, Cutler-Hammer Inc. remplacera gratuitement
le disjoncteur défectueux qui sera retourné au détaillant.

Exigences et limitations applicables aux garanties
émises par Cutler-Hammer Inc.:

FAUTE) OU AUTRES ASPECTS CONCERNANT CES
PRODUITS. EN AUCUN CAS CUTLER-HAMMER INC. NE
SERA RESPONSABLE DES AUTRES DOMMAGES, QU’ILS
SOIENT DIRECTS, INDIRECTS, ACCESSOIRES OU AUTRES.
D. Relativement aux produits achetés par les
consommateurs aux États-Unis à des fins d’usage per-
sonnel, les garanties tacites, y compris, mais sans s’y
limiter, les garanties relatives à la qualité loyale et
marchande, et à la convenance à un usage particulier,

II. Interruptores derivados tipo BR
Cutler-Hammer Inc. garantiza su disyuntor de derivación
tipo BR contra defecto de material y mano de obra bajo
condiciones normales de mantenimiento y de uso
adecuado en instalaciones residenciales por un período
de 5 años a partir de la fecha de instalación. Este plazo
se extenderá a 10 años si se instala un supresor de
sobrevoltaje y pararrayos Cutler-Hammer funcionando
en el centro de carga. Si el interruptor fallara dentro del
plazo de garantía debido a defectos de material o de mano
de obra, Cutler-Hammer Inc. a su criterio, reparará o
reemplazará la parte o las partes defectuosas contra su
devolución a lugar de compra.

Los requisitos de notificación y las limitaciones

CONSTITUYEN EL UNICO RECURSO DEL COMPRADOR
CON RESPECTO A LA GARANTIA DE ESTOS
PRODUCTOS, YA SEA BAJO CONTRATO, A CAUSA DE
ACTOS ILICITOS (INCLUYENDO NEGLIGENCIA O RESPON-
SABILIDAD OBJETIVA) O DE CUALQUIER OTRA FORMA.
BAJO NINGUNA CIRCUNSTANCIA CUTLER-HAMMER
INC. SERA RESPONSABLE DE DAÑOS DIRECTOS, INCI-
DENTALES, INDIRECTOS O DE OTRA INDOLE.
D. Con respecto a productos adquiridos por
consumidores de Estados Unidos para uso personal,
toda garantía implícita, incluyendo sin restricciones las
garantías de uso general y específico, no están
excluidas pero sí limitadas a la duración del plazo de
garantía pertinente. Algunos estados no permiten
restricciones en la duración del plazo de una garantía
implícita, por lo cual es probable que la limitación ante-
rior no se aplique a algunos usuarios. En forma similar,
algunos estados no permiten exclusiones o limitaciones
con respecto a daños incidentales o indirectos, por lo
