The 3DO Europe Ltd, Limited 90-Day Warranty

3DO Europe Ltd. ("3DO") warrants to the original purchaser of this 3DO software product that the

physical media within which the underlying computer program is recorded will be free from defects in

materials and workmanship under normal recommended use for ninety (90) days from the date of

purchase. The 3DO software program recorded within such medium is provided on an "as is" basis,

without any express or implied warranty of any kind, and 3DO shall not be liable for any losses or

damages resulting from any use or inability to use this 3DO software program. 3DO’s entire liability and

the original purchaser’s exclusive remedy for breach of any express or implied warranty shall be, at 3DO’s

option, either to replace or repair, free of charge, any defective media provided that this 3DO software

product is returned in its original condition within the 90-day warranty period to the place of original

purchase with a copy of the dated receipt or other proof of purchase. The preceding warranty is not

applicable and shall be void if any defect in this 3DO software product arises through accident, negligence,

unreasonable use or abuse, or results from any cause unrelated to defective materials or workmanship.

3DO’S LIMITED 90-DAY WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES

AND NO OTHER REPRESENTATIONS OR CLAIMS OF ANY NATURE SHALL OBLIGATE OR BE

BINDING UPON 3DO. ALL IMPLIED WARRANTIES WHICH CANNOT BE EFFECTIVELY

DISCLAIMED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF

MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE AND/OR NON-

INFRINGEMENT, ARE LIMITED TO THE 90-DAY PERIOD REFERENCED ABOVE. IN NO EVENT

SHALL 3DO BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL AND/OR OTHER

DAMAGES OF ANY KIND OR NATURE RESULTING FROM THE PURCHASE, POSSESSION, USE

OR INABILITY TO USE THIS 3DO SOFTWARE PRODUCT. THE PRECEDING WARRANTY GIVES

YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY

FROM JURISDICTION TO JURISDICTION.

This 3DO computer program and its documentation and other related materials are protected by U.K. and

other National and International copyright laws and treaties, as well as by other such intellectual property

laws and treaties. Reproduction, translation, modification, storage in a retrieval system, hiring, renting,

leasing, lending, broadcasting, transmission, and/or public performance is a violation of applicable laws

and is strictly prohibited without the prior written consent of 3DO Europe Ltd. or its parent, The 3DO

3DO has endeavoured to ensure that the end-user manual and promotional materials regarding this 3DO

product accurately reference the product. However, because of ongoing improvements and updating of

3DO products, 3DO cannot guarantee the accuracy of printed materials after the date of publication. 3DO

disclaims any loss, liability and/or damages, whether in contract, tort or otherwise, arising from any

inaccuracies or other information contained within the manual and/or promotional materials, including, but

not limited to, any loss or liability resulting from changes, errors or omissions regarding any of such items.
