Product warranty obligations are limited to the terms set forth below:
Hewlett-Packard Company (“HP”) warrants your print engine against defects in materials and workmanship for a period of
ONE (1) YEAR from the first date of installation at your site. Collectively the print engine and the ink jet print heads are referred
to herein as the "Product." This Limited Warranty covers manufacturer's defects in the Product and the media on which HP
software is recorded. Printheads, belts, motors and all associated mechanical components which are part of the Product are
excluded if the failure is due to causes listed under Exclusions below. This Limited Warranty does not cover ink, media and
supplies for the Product, such as the ink filters or UV bulbs (“Supplies”). Except as stated above, no warranty is made with
respect to the useful life of Supplies or defects in software.
If you discover a defect covered by this Limited Warranty, HP or a HP Authorized Representative will repair your Product with
either new or refurbished replacement parts. All replaced parts or components remain HP's property.
To obtain warranty service contact HP or your local Authorized Service Provider (ASP). You will be directed to a Qualified
Service Technician who will work with you to identify the cause of your problem and the actions necessary to resolve it. If on-site
service is required, as determined by HP, it will be provided at no cost.
Exclusions. This warranty does not cover any: (i) third party hardware or software, or (ii) damage caused by accident, abuse,
misuse (including damage resulting from head strikes or use of non-approved supplies), misapplication, relocation of Product
without approved procedures, loss or interruption of electric power, failure to perform user maintenance as defined in the
Product manual or contamination of the ink supply due to improper handling of the ink or ink system, or (iii) printheads which
have not been properly maintained as defined in the Product manual, and printheads with jet-outs that can be substituted in
Production print mode, or (iv) service (including upgrades and expansions) performed by anyone who is not a HP Authorized
Service Provider, or (v) modification of the Product without the written permission of HP, or (vi) Product on which the HP serial
number has been removed or defaced or for which you cannot provide proof of purchase and payment, or (vii) software
(whether embedded in ROMs or other hardware or contained on diskettes or other media), including related manuals and
documentation, its quality, performance, merchantability or fitness for any particular purpose, or (viii) taxes, tariffs, and duties
associated with the importing or exporting of warranty and non-warranty parts. ALL SOFTWARE IS LICENSED AND
DISTRIBUTED ON AN “AS IS” BASIS, UNDER THE TERMS OF THE APPLICABLE HP SOFTWARE LICENSE. In the event of
a conflict between this Limited Warranty and the applicable HP Software License, the latter terms and conditions will prevail.
THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS, WHETHER
ORAL OR WRITTEN, EXPRESS OR IMPLIED. HP SPECIFICALLY DISCLAIMS ANY AND ALL OTHER WARRANTIES,
INCLUDING, WITHOUT LIMITATION, WARRANTIES OF NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE. NO HP EMPLOYEE, AGENT OR DEALER IS AUTHORIZED TO MAKE ANY MODIFICATION,
EXTENSION OR ADDITION TO THIS LIMITED WARRANTY. HP IS NOT RESPONSIBLE FOR DIRECT, SPECIAL,
INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR THE LIKE RESULTING FROM ANY BREACH OF WARRANTY OR
UNDER ANY OTHER LEGAL THEORY, EVEN IF HP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
HP’s aggregate liability as a result of any single event or series of events, whether as a result of negligence, breach of contract,
misrepresentation or otherwise, shall in no circumstance exceed the cost of the Product, Supplies, or any services purchased
whether defective, damaged or undelivered, as determined by the net invoice price.
Some states and countries do not allow the exclusion or limitation of incidental or consequential damages or exclusions of
implied warranties, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights,
and you may also have other rights that vary from state to state or in your country.
