INFRINGEMENT OR OTHER CLAIMS ARISING FROM YOUR USE OF THE LOGO. YOUR USE

OF THE LOGO IS AT YOUR OWN RISK. YOU AGREE TO INDEMNIFY CARLSBAD CUBES

AGAINST ANY CLAIMS OR LIABILITY THAT MAY ARISE FROM YOUR USE OF THE LOGO.

(9) This Application/Agreement shall be governed by California law and controlling U.S. federal law.

This Application/Agreement is the parties' entire agreement relating to its subject matter, and it may not

be modified unless in writing signed by an authorized representative of each party. Notwithstanding the

foregoing, if any use of the Logo is governed by existing agreements you have entered into with

Carlsbad Cubes this agreement does not supersede or alter the terms of such other agreements.
