information, instructions, and materials concerning the Proposition 65 warnings, to the extent the
warnings apply to our company. It is my company’s intention to comply with the Proposition 65
warning requirements. Furthermore, I agreed to the contents of this letter, specifically including
the indemnification of Kohler, Co. and its subsidiaries, affiliates, and manufacturers from any and
all damages, penalties, fees, costs and expenses resulting in whole or in part from any causes of
action related to Title 27 California Code of Regulations Article 6 Clear and Reasonable Warnings.
