7.11 Warranty Laws
• Thefollowinglawsgovernwarrantiesthatariseinretailsalesofconsumergoods:

• TheCaliforniaUniformCommercialCode,DivisionTwo[ComC§§2101etseq],andThe
federalMagnuson-MossWarrantyFederalTradeCommissionImprovementAct[15USC
§§2301etseq;16CFRParts701–703].AtypicalMagnuson-MossActwarrantyisa
writtenpromisethattheproductisfreeofdefectsorawrittenpromisetorefund,repair,
orreplacedefectivegoods.[See15USC§2301(6).]Remediesincludedamagesforfailing
tohonorawrittenwarrantyorservicecontractorforviolatingdisclosureprovisions.[See
15USC§2310(d).]Exceptforsomelabelinganddisclosurerequirements,thefederalAct
doesnotpreemptstatelaw.[See15USC§2311.]
TheConsumerWarrantyActdoesnotaffecttherightsandobligationsofpartiesunderthe
stateUniformCommercialCode,excepttheprovisionsoftheActprevailoverprovisionsofthe
