M-D Building Products, Inc. (MDBP) warrants that ProVa Flex will meet all composition criteria for 25 years from the date of purchase. Additionally, ProVa Flex will conform
to its performance criteria for 5 years from the date of purchase if the floor covering system was subjected to normal usage and installed in accordance with the ProVa Flex
installation instructions and the installation standards of the Tile Council of North America (TCNA).
DISCLAIMER
This warranty is given in lieu of any other warranty expressed or implied including warranties, representations and conditions of merchantability. MDBP assumes no liability
or responsibilities for lost profits, losses due to delays or any indirect, incidental, punitive, exemplary or consequential damages, acts of nature including but not limited to
flooding, hurricane, tornado, earthquakes; acts of war, terrorism, intentional acts of destruction and fire shall not be covered under this warranty. Damage due to structural
movement, excessive deflection or other failure of the substrate and damage to structural or subfloor elements from water are also not covered.
ACCEPTABLE MATERIALS AND CONDITIONS
It is the responsibility of the owner/installer to ensure the suitability of all materials and associated building materials for the owner’s intended use.It is recommended that
the owner consults and/or obtains the services of an experienced and professional installer.
WARRANTY CLAIMS
For claims under this limited warranty, the owner must have completed the warranty registration within 30 days of installation and sent it to MDBP at the address below. The
warranty registration information must include the date and proof of purchase as well as the name and address of installers. Claims without a completed warranty registration
cannot be honored.
MDBP must be notified in writing, at the address below, within 30 days of the discovery of the defect to request a claim. Failure to follow this procedure
shall render the warranty null and void.The original owner must then, at
MDBP’ s discretion, allow an inspection of the installation. If upon inspection, MDBP determines ProVa
Flex
fails to meet this warranty, then MDBP will, at its discretion, reinstall or replace the failed portion of the floor covering system OR pay to the owner, an amount up to but
not exceeding the original cost per square foot for the failed portion of the floor covering system.In either case, any remediation will be subject to
MDBP receiving a signed
release of further liability from the owner.Additionally, due to conditions beyond the control of
MDBP , such as but not limited to, color and design availability, discontinuation
of styles, normal wear and tear,
MDBP cannot guarantee exact matching of replacement tile, stone or other flooring materials to be used. MDBP shall use or shall instruct to
be used materials that conform to the contract requirements that are substantially similar to the original floor covering system.The floor covering system includes
ProVa
Flex
, non reusable floor surfaces, the appropriate adhesives, setting materials and labor.
The claim must be submitted and evaluated by
MDBP before any repair work is done. For any claim that is not valid, MDBP will be reimbursed for reasonable charges, including
travel and labor, associated with investigation of such claim.
This limited warranty extends only to the original owner as stated on the recorded warranty registration card and is not transferable.Further, this limited warranty replaces
any and all previous written and oral warranties and is effective with any installation after February 10, 2014.

MDBP garantiza que ProVa Flex cumple con todos los criterios de composición durante 25 años desde la fecha de compra. Además, ProVa Flex se conformará a su criterio de rendimiento durante 5 años
a partir de la fecha de compra si el sistema de revestimiento de piso estuvo sujeto al uso normal y fue instalado de acuerdo con las Instrucciones de instalación de ProVa Flex y las normas de instalación
del Tile Council of North America (TCNA).
CLÁUSULA DE EXENCIÓN DE RESPONSABILIDAD
Esta garantía se otorga en lugar de cualquier otra garantía explícita o implícita, incluyendo las garantías, declaraciones y condiciones de comercialización. MDBP no asume responsabilidad alguna por la
pérdida de ganancias, pérdidas ocasionadas por demoras o daños indirectos, accidentales, punitivos, ejemplares o resultantes. Causas de fuerza mayor pero no limitadas inundaciones, huracanes, tornados,
terremotos; actos de guerra, terrorismo, actos intencionales de destrucción e incendio no están amparados por esta garantía. Los daños ocasionados por el movimiento estructural, la desviación excesiva
u otra falla del sustrato y los daños a los elementos estructurales o del contrapiso ocasionados por el agua tampoco están amparados.
MATERIALES Y CONDICIONES ACEPTABLES
Es responsabilidad del propietario/instalador garantizar la idoneidad de todos los materiales así como de los materiales de construcción relacionados con el uso previsto por parte del propietario. Se
recomienda que el propietario consulte y/o obtenga los servicios de un instalador profesional experimentado.
RECLAMACIONES EN GARANTÍA
Para las reclamaciones relacionadas con esta garantía limitada, el propietario debe haber completado la inscripción para la garantía en el lapso de 30 días de haber realizado la instalación y haberla
enviado a
MDBP a la dirección que se encuentra en este documento. La información de la inscripción de la garantía debe incluir la fecha y la prueba de compra así como el nombre y la dirección de los
instaladores. No se aceptarán las reclamaciones sin una inscripción de garantía. Para solicitar el cumplimiento de la garantía, se debe notificar a
MDBP a la dirección que aparece en este documento,
dentro del plazo de 30 días de haber descubierto el defecto. El incomplimiento de este procedimiento anulará la garantía. El propietario original debe, a discreción de
MDBP , permitir la inspección de la
instalación. Si durante el transcurso de la inspección
MDBP determina que ProVa Flex no ha cumplido con esta garantía, la empresa, a su discreción, volverá a instalar o reemplazar la porción que presenta
fallas en el sistema de revestimiento del piso O pagará al propietario una cantidad que sea igual al costo original por pie cuadrado de la porción del sistema de revestimiento de piso que presentó fallas,
pero que no exceda tal costo. En cualquier caso, la corrección estará sujeta a que recibamos del propietario una notificación firmada sobre exención de responsabilidad adicional por parte de
MDBP .
Además, debido a las condiciones que se encuentran más allá del control de
MDBP , tales como, entre otras, la disponibilidad del color y el diseño, los estilos descontinuados, el uso y desgaste normales,
MDBP no puede garantizar la compatbilidad exacta de las baldosas o piedras de reemplazo o de otros materiales de revestimiento de piso que se vayan a utilizar. MDBP utilizará o indicará que se utilicen
materiales que se adapten a los requisitos del contrato que son sustancialmente similares al sistema de revestimiento de piso original. El sistema de revestimiento de piso incluye ProVa Flex, superficies
de piso no reutilizables, los adhesivos adecuados, los materiales de curado y la mano de obra.
La reclamación que se envíe será evaluada por
MDBP antes de proceder con el trabajo de la reparación. En caso de reclamaciones que no sean válidas, MDBP reembolsará los costos razonables, incluyendo
los viajes y mano de obra, relacionados con la investigación de tal reclamación.
Esta garantía limitada se extiende solo al propietario original según se establece en la tarjeta de inscripción de la garantía y no es transferible. Además, esta garantía limitada reemplaza todas y cada una
de las garantías previas escritas u orales y entra en vigencia con cualquier instalación posterior al 10 de febrero de 2014.
