5. Restrictions. You may not r ent, lease, loan or resell the Software. You may not permit
third p arties t o benefit from th e use or functiona lity of the Software via a timesharing,
service bureau or other arrangement, except to the extent such use is specified in the
applicable list price or product packaging for the Software. You may n ot transfer any of
the rights gr anted to y ou under th is Agreement. You may not r everse engineer,
decompile, or disassemb le the Software, except to the extent the foregoing restriction is
expressly pr ohibited by applicable law. You may not modify, or create derivative w orks
based upon, the Software in whole or in part. You may not copy the Software or
Documentati on except as expressly per m itted in Section 1 above. You may not r emove
any proprietary notices or labels on the Software. All rights not expressly set forth
hereunder ar e r e served by McAfee. McAfee reserves t he r ight to periodically conduct
audits upon advance written notice to verify compliance with the terms of this
Agreement.
6. Warranty and Disclaimer
a. Limited Warranty. McAfee warrants that for sixty (60) days from the date of original
purchasethemedia(e.g.,diskettes)onwhichtheSoftwareiscontainedwillbefreefrom
defects in materials and wo rkmanship.
b. Customer Remedies. McAfe e's and its suppliers' entire liability and your ex clus ive
remedy for any breach of the foregoing war ranty shall be, at Mc Afee's option, eith er (i)
return of the purchase price paid fo r the license, if any , or (ii) replacement of the
defective media in which the Software is co ntained. You must ret urn the defective
media to McAfee at yourexpensewith acopy of yourreceipt. This limitedwarranty is
voidifthedefecthasresulted fromaccident,abuse,ormisapplication.Anyreplacement
media will be warranted forther emainderofthe original w arranty period. Outside the
United States, this remedy isnot availableto the ex tent McAfee issubject to restrictions
under United States export control laws and regulations.
c. Warranty Disclaimer. Except for the li mited warranty set forth herein, THE
SOFTWARE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY
APPLICABLE LAW, MCAFEE DISCLAIMS ALL W ARRANTIES, EITHER EXPRESS
OR IM PLIED, INCLUDING BUT NOT LIMITED TO IMPLIE D WARRA NTIES OF
MERCHANTABIL ITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NONINFRINGEMENT WITH RESPECT TO THE SOFTWARE AND THE
ACCOMPANYING DOCUMENTATION. YOU ASSUME RESPONSIBILITY FOR
SELECTINGTHESOFTWARETOACHIEVEYOURINTENDEDRESULTS,ANDFOR
THE INSTALLATION OF, US E O F, AND RES ULTS OBTAINED FROM THE
SOFTWARE. WITHOUT LIMITING THE FOREGOING PROVISIONS, M CAFEE
MAKES N O WARRANTY THAT THE SOFTWARE WILL BE ER ROR-FRE E OR FR EE
FROM INTERRUPTIONS OR OTHER FAILURES OR THAT THE SOFTWARE W ILL
MEET YOUR REQUIREMENTS. SOME STATES AND JURISDICTIONS DO NOT
ALLOW LIMITATIONS ON IMPLIED W ARRANTIES,SO THE ABOVE LIMITATION
MAY NOT A PPLY T O YOU. The fo regoing provisions shall be enfo rceable to th e
maximum extent per m itted by applicable law.
