10.High Risk Activities. The Soft ware is not fault-tolerant and is not de signed or intended
for use in hazardous environments requiring fail-safe performance, including without
limit ation, in the op eration of nuclear facilities, aircraft navigation or communicat ion
systems, air traffic c o ntrol, w eapons systems, direct life-support machines, or a n y other
application in which the failure o f t he Software could lead dir ectly t o death, pe rsonal
injur y , or severe physical or property damage (collective ly, "High Risk Activities").
McAfe e expressly disclaims an y express o r implied warra nty of fitness for High Risk
Activities.
11.Miscellaneou s. This Agreement is governed by the laws of the United States and the State
of California, without reference to conflict of laws principles. The application of the
United Nations Convention of Contracts for the International Sale of Goods is expressly
excluded. This Agreementsets forth allrightsfor theusero f t heSo ftware andistheentire
agreement between the parties. This Agreement supersedes any o ther communications
with respect to the Software and Documentation. This Agreement may not be modified
exceptby a written addendum issued by a duly authorized representativeo f Mc Afee. No
provision hereof s hall be d eemed w aived unless such waiver shall be in writi ng and
signed by McAfeeor a duly authorizedrepresentativeof McAfee. Ifany provision of this
Ag ree ment is held inva lid, the r emainder of this Agree ment shall continue in full force
and effect. The parties confirm that it is their wish that this Agreement has been written
in th e English language only.
