Limited Warranty
Rochester Concrete Products, LLC. (RCP) warrants Rockwood Retaining Wall materials manufactured by it to be free from defects in materials. If Rockwood is used to build a properly constructed retaining wall and maintained under normal use, it will give satisfactory service for a period of Ten (10) years. If the Rockwood materials in a wall fail on account of defects in the materials, RCP will supply new Rockwood Materials to be used in rebuilding the wall. Replacement of defective materials to buyer is RCP’s sole obligation and buyer’s exclusive remedy. RCP’s sole obligation does not extend to supplying the labor or equipment necessary to rebuild the wall. RCP shall not be liable for any consequential damages arising out of the failure of a Rockwood Retaining Wall.
Neither shall RCP be liable to replace any Rockwood materials in a retaining wall that has been subject to
improper
handling, improper wall design, improper installation, repeated or extended contact with chemicals such as deicers, or Acts of God.
