STATEMENT OF LIMIT OF
LIABILITY
PRODUCT WARRANTY
In the case of goods having a special written warranty, that warranty shall apply. Otherwise, Owens
Corning Sales, LLC (“Owens Corning”) warrants only that the goods shall be manufactured in
accordance with its published specifications.
THERE ARE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE
WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PURPOSE, EVEN IF
DISCLOSED TO OWENS CORNING.
LIMITATION OF LIABILITY
Buyer’s exclusive remedy for goods proven to be other than as warranted, provided Buyer makes its
claim within one year of the date of shipment of the goods, shall be at Owens Corning’s option, the repair
or replacement of the goods, without charge, F.O.B. point of destination, but only within the continental
United States.
Owens Corning’s liability for any and all loss or damage to Buyer, or its customers, resulting from any cause
whatsoever, including Owens Corning’s negligence, damaged or defective goods, irrespective of whether
such defects are discoverable or latent, from strict liability, tort, if Owens Corning’s
warranty shall
fail in
its essential purpose, or for any other cause, shall in no event exceed the purchase price of the particular
goods with respect to which losses or damages are claimed.
IN NO EVENT SHALL OWENS CORNING BE LIABLE FOR BUYER’S INCIDENTAL, SPECIAL,
CONSEQUENTIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, HOWEVER ARISING.
No statement or recommendation made or assistance given by Owens Corning, or its representatives, either
oral or in its literature, to Buyer or to Buyer’s representatives, or customers, in connection with the use or
installation, by Buyer, its representatives or its customers, of any goods sold hereunder, shall constitute a
waiver by Owens Corning of any provision hereof or affect Owens Corning’s liability herein defined.
Owens Corning assumes no responsibility for goods not manufactured by it. All such goods carry only
the warranty, if any, of the manufacturer of the goods.
