Congratulations on your purchase of this ENERGY STAR labeled, Progress Lighting, Inc. (Progress Lighting)
fixture. Fixtures that carry the ENERGY STAR label meet efficiency and quality criteria to assure that consumers
will not sacrifice performance to save energy and reduce pollution generated by electricity.
This new generation of fixtures for the home is designed to emit the equivalent amount of light (lumens) as
incandescent models, while matching the color rendering properties that consumers are accustomed to in their
homes. The efficient light bulbs used in these fixtures also last as much as twelve times longer than typical
incandescent bulbs. Convenience is also an important feature of ENERGY STAR labeled fixtures. The fixtures
start immediately and operate at a minimal noise level compared to the older generation of fluorescent fixtures.
Reliability and safety performance criteria must also be met by any fixture carrying the ENERGY STAR label. The
fixtures carry a three-year warranty (excluding lamp) and are tested to applicable National Electrical Code and
ANSI/IEEE Standards. Please refer to warranty information below.

LIMITED WARRANTY AND EXCLUSIVE REMEDY: When properly installed and under normal conditions
of use, Progress Lighting products warrants to its customers that the products sold will be free from defects in
material and workmanship at time of shipment. The ballast manufacturer’s warranty will apply to all ballasts
supplied with the fluorescent units. All warranty claims, including ballast warranty claims, must be asserted within
three years from date of shipment of the subject products. Thereafter, warranty claims will not be honored. The
Customers sole remedy for a warranty claim or otherwise shall be limited to repair or replacement of the subject
product if it is shown to have been defective in material or workmanship at time of shipment. Progress’s sole and
maximum liability for a defective product shall never exceed the cost of the subject product. EXCEPT FOR
SUCH A WARRANTY AND EXCLUSIVE REMEDY AS STATED HEREIN (AND THE EXPRESS
WARRANTY OF TITLE), PROGRESS LIGHTING DISCLAIMS ALL OTHER WARRANTIES,
WHETHER EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS THE IMPLIED
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO
EVENT SHALL PROGRESS LIGHTING BE LIABLE TO CUSTOMER IN WARRANTY, CONTRACT,
NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, FOR ANY DAMAGES, WHETHER
INCIDENTAL OR CONSEQUENTIAL, WHICH ARE ALLEGED TO BE CAUSED BY ONE OR MORE
OF OUR PRODUCTS, BEYOND THE COST TO THE CUSTOMER OF THE SUBJECT PRODUCT OR
PRODUCTS. Therefore, the customer's sole and exclusive remedy against us for breach of the warranty, breach of
contract or negligence or strict liability or otherwise shall be limited to repair or replacement of the subject product
at our option or, if we choose, refund of the purchase price. Progress Lighting shall in no event be responsible or
liable for modifications, alterations, misapplication or repairs made to its products by customer or others, or for
damage caused thereto by negligence, accident, or improper use by customer or others. This warranty does not
include reimbursement for the expenses of labor, transportation, removal or reinstallation of the products. In no case
does our warranty and exclusive remedy extend to anybody other than our customers. Our customers are not
authorized to extend warranties or remedies on our behalf to anyone. Such unauthorized extensions of warranties or
remedies by the customer shall remain customer’s responsibility. Customer is responsible for determining the
suitability of our products for customer’s use or resale, or for incorporating them into objects or for applications
which customer designs, assembles, constructs or manufactures.
