dur ation is ex ceeded. Rate s that v ar y based on the time
of acce ss will be determined based on the location of
the netw ork equipment providing ser vice and not the
location of y our De vice or y our De vice ’ s are a code (if
applicable ).
Push-to- T alk Char ge s: Char ge s f or push-to-t alk
calls are billed to the per son who st ar ts the call and
calculated b y multiplying the dur ation of the call b y
the applicable r ate and number of participants. Y ou’ r e
char ged at least 6 seconds of air time f or e ach call you
st ar t; subsequent communications in the same call
are rounded up to and billed to the ne xt second. T ime
begins when you pr e ss an y button to st ar t a push-
to-t alk call and ends appr o ximately 6 seconds af ter
completion of a communication to which no par ticipant
r e sponds. S ubsequent push-to-t alk communications
are considered ne w calls. Char ge s apply f or the entir e
period of time the push-to-t alk call is connected to
our netw ork. Depending on y our plan, nation wide ,
international, or gr oup push-to-t alk calls may use
the local push-to-t alk minute s in y our plan and r e sult
in additional or diff er ent charge s. R esponse s to call
aler t tr ansmissions are tr e ated as ne w push-to-t alk
tr ansmissions e ven when r e sponding within 6 seconds
of r eceiving the aler t. Push-to-talk billing methods are
subject to change as w e introduce ne w push-to-t alk
Ser vice s.
Dat a U sage: U nle ss w e specifically tell you other wise ,
dat a usage is me asur ed in b y te s, kilob y te s, megaby te s,
and gigab y te s—not in minute s / time . 102 4 b y te s equals
1 kilob y te (“KB”), 102 4 KB equals 1 megaby te , and 102 4
megaby te s equals 1 gigab y te . B y te s are rounded up
to KB, so you will be char ged at least 1 KB f or e ach dat a
usage se ssion (“ dat a se ssion ”). R ounding occur s at the
end of e ach dat a se ssion, and sometime s during a dat a
se ssion. Depending on y our dat a Ser vice s, usage may
be char ged against an allo w ance or on a fixed price per
KB, and you may be subject to limit ations on the amount
of dat a usage . If you are char ged on a fixed price per KB,
an y fr actional cents will be rounded up to the ne xt cent.
Y ou are char ged f or all dat a directed to y our De vice ’ s
Internet addr e ss, including dat a se ssions you did not
initiate and f or incomplete tr ansf er s. As long as y our
De vice is connected to our dat a netw ork s, you may
incur dat a charge s. E xample s of dat a f or which you will
be char ged include s the siz e of a r equested file or Dat a
Content (game , ringer , etc .); W eb page gr aphics (logos,
pictur e s, banner s, advertisement, etc .); additional
dat a used in acce ssing, tr anspor ting, and routing the
file on our netw ork; dat a fr om partial or interrupted
do wnloads; r e-sent dat a; and dat a associated with
unsucce ssful attempts to r e ach w ebsite s or use
applications. These dat a charge s are in addition to an y
charge s f or the Dat a Content itself (game , ringer , etc .).
Dat a used and char ged to you will v ar y widely , e ven
betw een identical actions or dat a se ssions. Estimate s
of dat a usage—f or e xample , the siz e of do wnloadable
file s—ar e not r eliable predictor s of actual usage . Y our
bill won’t separ ately list the number of KB attributed to a
specific action/dat a se ssion.
Y our Bill
Y our bill pro vide s you notice of y our charge s. It r eflects
monthly recurring charge s (usually billed one bill c ycle
in advance ), f ee s, t ax e s, S urcharge s, pr oduct and
equipment charge s, subscription charge s, and usage/
tr ansaction specific charge s (usually billed in the bill
c ycle in which the y’ r e incurr ed). Some usage charge s,
such as those that depend on usage information fr om
a thir d par ty , may be billed in subsequent bill c ycle s
and r e sult in higher than e xpected charge s f or that
month. Bill c ycle s and date s may change fr om time
to time . Y our bill ma y also include other impor t ant
notice s (f or e x ample , change s to your A gr eement, to
your Ser vice , legal notice s, etc .). Y our paper bill may
