3.2 Conditions: The Siemens Industry Warranty applicable to every SPD and the Covered Equipment Coverage are subject to

and conditioned upon the following requirements being fully satisfied:

(a) All electrical work must be performed by a qualified technician. Always follow the National Electrical Code (NEC), or the
62
Canadian Electrical Code (CEC) as well as all local, state and provincial codes. Code questions should be directed to
63
your local electrical inspector or code enforcement agency. Failure to follow electrical codes and OSHA safety standards
64
may result in personal injury or equipment damage. Failure to follow manufacturer's installation instructions may result in
65
electrical shock, fire hazard, personal injury, death, damage to equipment, unsatisfactory performance and may void
66
manufacturer's warranty.

(b) The electrical system into which the SPD is installed must be properly grounded in full satisfaction of the National
68
Electrical Code (NEC) or Canadian Electrical Code (CEC) requirements.

(c) The SPD must be properly installed and connected in compliance with Siemens Industry instructions by a licensed
70
electrician or electric utility company personnel and in accordance with all local, state and provincial codes, and the
71
requirements stated below:

(1) Total Home Protectors: Siemens Industry’s AC Protector/s (FS060, FS100, FS140, TPS3A1110D, or
73
TPS3AL12300X0) and incoming cable/telephone (FSCATV or FSPHONE) protectors are recommended to be
74
installed by a licensed electrician or electric utility personnel. Siemens Industry installation instructions and diagrams
75
must be followed. The FS060, FS100, FS140 must be installed to a spare two-pole 20A breaker, and the installation
76
wires should be trimmed to be as short as possible. When installed, the appropriate indicator lights must be
77
illuminated along with no audible alarm sounding. Installation must conform to the most current applicable codes
78
(NEC or CEC). The AC power electrical system must be properly grounded and the phone and coax ground must be
79
bonded to the AC Power ground per NEC requirements.

(2) Exterior Protectors: Siemens Industry’s HVAC, irrigation, or pool pump (TPS3A03050) protector is
81
recommended to be installed by a licensed electrician. Siemens Industry installation instructions and diagrams
82
must be followed. I n sta llat i o n must conform to the most cu rr en t applicable NEC articles.

(d) The SPD must be used at all times in the manner for which it is des i g ne d and intended by Siemens Industry.

(e) The SPD must not have been modified or altered in any way.

(f) Siemens Industry must receive written notice of any SPD defect within 30 days following discovery of the defect and
86
written notice of any damage caused by electrical surge within 30 days following the o ccu rr en ce.

(g) The SPD will be inspected by Siemens Industry for electrical surge damage. The SPD must show signs of electrical
88
surge damage or must perform o u t s i d e (greater than 10%) of d e si g n specifications for surge protection
89
ca p a bility.

3.3 Limitations: To the fullest extent p e r m i t te d by law, and except for the expressed Siemens Industry Warranty and the
92
Connected E q u i pm en t Coverage stated herein, Siemens Industry does not make and s pec i f ically d isclaims any and all
93
implied w a rr ant i e s , including war r a n t i es of merchantability and/or fitness for a particular use. In the event of a
94
determination by Siemens Industry that an SPD is defective or has failed during the a pplica b le Warranty Term, the
95
responsibility of Siemens Industry will be limited to: 1) the repair or replacement of the SPD with a like kind and quality
96
product, at the discretion of Siemens Industry; and 2) paying the cost to repair o r replace damaged covered e q u i pm en t ,
97
whichever amount is less. Siemens Industry shall not be responsible for consequential or incidental damages,
98
including without limitation damages to equipment and loss of revenue. Siemens Industry shall not be responsible for
99
charges related to the shipping of the damaged SPD to Siemens Industry for i n spec t i o n .

IV. GENERAL PROVISIONS:

4.1 Applicable Law: All terms and provisions of the Siemens Industry Warranty and Co nn ec te d E q u i pm en t Coverage shall be

construed by, under and in accordance with the laws of the State of Florida, u n less su c h application of law is
105
specifically prohibited in any venue having proper jurisdiction to resolve issues involving t he Siemens Industry Warranty
106
and the Connected Equipment Cove rag e .

4.2 Dispute Resolution: Any claim, demand or issue pertaining to an SPD, the Siemens Industry Warranty and/or the
109
Connected Equipment Coverage shall be settled and resolved by Arbitration administered by the American Arbitration
110
Association under its Commercial Arbitration R u le s. The Arbitration shall be co n d u c t e d b e f o r e a single arbitrator in
111
Pinellas County, Florida. Any decision rendered in such Arbitration shall be final a n d bi n d in g upon all p a r t i e s. The
112
Arbitrator shall not award either party special, exemplary, consequential, punitive , incidental or indirect damages or
113
a tt orn ey ’ s fees. The Arbitration costs and Arbitrator fees shall be equally divided between the parties, and each party
114
will pay its own Attor n ey ’s F ee s .

4.3 Notice: Any notice to Siemens Industry shall not be deemed to be made unless and until it is received by Siemens

Industry at the address stated b e low:
