These Terms of Use include terms and conditions applicable to both

Pictures (the picture or digital image storage, manipulation and

access service including the Pictures Web site, pictures.sprintpcs.com

)

and your PCS Vision Camera. These terms are broken down in two

sections below - SERVICE TERMS and EQUIPMENT TERMS. Also

attached below are the applicable Sprint Security Policy and

Sprint Privacy Policy.

By accessing any areas of the Pictures Web site or by becoming a

registered user or by using the picture storage, manipulation and

access service ("Service" and "Services") through the use of the

Pictures Web site, or by use of your PCS Vision camera, you agree with

Sprint that you are bound by the terms set forth below. The terms of

this agreement include terms on use of Pictures Web site, terms on

the purchase of PCS Products and Services, and terms regarding

the Pictures Web site are also included on the Pictures Web site.

For purposes of these terms, "Sprint" means (1) entities controlled by,

under common control with or controlling Sprint Spectrum Holding

Company, L.P., including without limitation Sprint Spectrum L.P.,

SprintCom Inc., and PhillieCo L.P., (2) any contractual affiliate of the

entities in (1) above that are authorized to use the Sprint brand name

and which either sell wireless services or manage a portion of the

enhanced Sprint Nationwide PCS Network.

Vision and the diamond logo are registered trademarks of Sprint

Communications Company L.P., used under license.

TERMS APPLICABLE TO ALL SERVICES AND EQUIPMENT

This agreement is governed by the laws of the State of Kansas, and

the United States of America. Use of the Service and PCS Vision

camera is unauthorized in any jurisdiction that does not give effect to

all provisions of these terms and conditions, including without

limitation this paragraph. You agree that no joint venture,

partnership, employment, or agency relationship exists between you

and Sprint as a result of this agreement or use of the Service or the

PCS Vision camera. The performance of Sprint in this agreement is
