Limited Warranty
Subject to the terms and limitations below, and provided the product is installed and maintained in accordance with dassoXTR’s
(“XTR”) instructions and maintenance guidelines, XTR warrants to the original purchaser (“Purchaser”) of dassoXTR Fused Bamboo
exterior decking product (“Product”) that the Product will be free from material defects in workmanship and materials, and will not
suffer structural damage from insects, termites or fungal decay. Purchaser must, within the first sixty (60) days after purchase, fill out
and submit the attached Warranty Registration. Purchaser’s failure to submit the Warranty Registration within the first sixty (60) days
after original purchase voids all Product warranties. In the event Purchaser timely submits the attached Warranty Registration, the
Product warranty shall be for a term of thirty (30) years for residential application (defined as individual residences) and ten (10) years
for commercial application (defined as non-residential installation), beginning on the date the Product was first purchased from an
authorized XTR dealer.
If a defect occurs within the applicable warranty period, Purchaser shall directly notify XTR in writing within thirty (30) days of discovery
of any Product defect. The warranty notification shall be sent or delivered to the address(es) set forth herein and in the Warranty
Registration. Subject to the Warranty Scale below, XTR’s sole responsibility shall be, at XTR’s option, to either replace the defective
Product or refund the attributable portion of the purchase price paid by Purchaser for the defective item (which shall no t, to the fullest
extent permitted by law, include freight, removal of defective product, installation of replacement product, labor or additional costs
or expenses).
Warranty Scale: If a residential Purchaser submits a valid warranty claim during Product years fifteen (15) through twenty-five (25),
XTR’s sole warranty responsibility of replacement or refund shall be reduced by ten percent (10%) for each successive year. For
example, in the event Purchaser timely submits a valid warranty claim in Product year seventeen (17), XTR’s warranty obligations shall
be reduced by twenty percent (20%).
The foregoing represents Purchaser’s sole and exclusive remedy for any Product defects. In the event product is supplied to replace
defective product, the warranty period for the replacement product shall not be extended beyond the original warranty period. This
Product warranty may be transferred one (1) time within the first five (5) years after the original purchase date to a subsequent buyer
of the property upon which the Product was originally installed.
XTR does not warranty against and is not responsible for any condition attributable to: (i) improper gapping; (ii) improper installation;
(iii) use of unauthorized, unfitting or unapproved materials, clips or accessories; (iv) use of XTR products beyond normal and ordinary
use and conditions, or in applications not recommended by XTR’s guidelines, instructions, local buildings codes or that violate either
state or federal laws; (v) movement, distortion, collapse or settling of the ground or the supporting structures; (vi) any act of God
(force majeure); (vi) environmental conditions, such as air pollution, mold, mildew, etc., or staining from foreign substances such as
dirt, grease, oil, etc.; (vii) normal weathering from sunlight, weather and atmosphere, causing color change, checking, grain
raise/splintering, cupping and other forms of movement; (viii) variations and degradation in color/grain; (ix) variations and fading over
time, caused from usage, foot traffic, variations of color among individual planks and failure to periodically maintain the Product in
accordance with XTR’s guidelines; (x) improper handling, storage, neglect or abuse of XTR Product by Purchaser or any third parties;
(xi) any damage caused by any product, applicator, seal, oil, varnish, stain or other product not manufactured or supplied by XTR (in
which event, Purchaser agrees to look solely to any such third party and expressly agrees that XTR shall have no liability for any such
outside products, even if recommended by XTR); and (xii) normal wear and tear.
Purchaser agrees that, except as provided for herein, XTR is not liable for any statements or promises made as to the quality,
performance or fitness of this Product and agrees that any and all recovery and liability against XTR is limited to the terms and
obligations contained herein. Purchaser further acknowledges and agrees that, TO THE FULLEST EXTENT PERMITTED BY LAW, XTR
SHALL NOT BE LIABLE TO PURCHASER, ANY TRANSFEREE OR ANY THIRD PARTIES FOR INCIDENTAL, CONSEQUENTIAL OR PUNITIVE
DAMAGES ARISING HEREUNDER OR IN ANY WAY RELATED TO THE PRODUCT, INCLUDING IN CONTRACT, TORT OR OTHERWISE. XTR’S
SOLE LIABILITY SHALL IN NO EVENT EXCEED THE COSTS OF REPLACEMENT OF THE DEFECTIVE PRODUCT OR THE REFUND OF THE
ATTRIBUTABLE PURCHASE PRICE OF THE DEFECTIVE PRODUCT. Some states or provinces do not allow the foregoing exclusions or
limitations and may not apply to you. Purchaser may have other legal rights afforded in Purchaser’s state or province. All claims or
causes of action shall be brought exclusively in Gwinnett County, Georgia and construed in accordance with the laws of the State of
Georgia.
All warranty registrations, notices or claims shall be sent to the address(es) in the attached Warranty Registration Form.
