10-Year Limited Warranty
Fin Pan, Inc. warrants for a period of ten (10) years from date of purchase that the PreFormed
Shower Pan and ProPan Shower Base (the “Product”) meet or exceed applicable manufacturing
standards in force at the time of manufacture. Fin Pan will, at its option, repair or replace any
Product which proves defective due to manufacturing. This warranty shall apply only if the
Product is used strictly according to applicable specifications, and/or instructions provided by Fin
pan for its use. Fin Pan shall not be liable otherwise.
Replacement of any defective Product or, at Fin Pan’s option, refund of the purchase price of any
defective Product shall be the buyer’s sole remedy under this warranty. Fin Pan shall, in no
event, be held liable for any consequential, incidental or special damages. This warranty
constitutes the sole warranty given by Fin Pan, Inc. in connection with this Product. Fin Pan, Inc.
has authorized no person or company to make or give any other warranties or representations on
its behalf.
In particular, there are no implied warranties including, without exception, warranties or
merchantability or fitness for a particular purpose. This warranty shall only be valid if the
Product is stored or maintained according to Fin Pan’s specifications. No modifications of this
warranty in favor of any buyer shall be valid unless given in writing and signed by an authorized
representative of Fin Pan, Inc. This warranty gives you specific legal rights, and you may also
have other rights which vary from state to state.
SUITABILITY OF PRODUCTS: IT IS THE RESPONSIBILITY OF THE
OWNER/BUILDER/INSTALLER TO ENSURE THE SUITABILITY OF ALL BUILDING
MATERIALS AND ALL ASSOCIATED BUILDING MATERIALS FOR THE OWNER’S
INTENDED USE. IT IS RECOMMENDED THAT THE OWNER CONSULT WITH AN
EXPERIENCED AND PROFESSIONAL INSTALLER.
CLAIMS ON THIS LIMITED WARRANTY: To make a claim under this Limited Warranty, the
owner must provide Fin Pan, Inc with written notice within 30 days of any alleged defect in the
Product covered by this Limited Warranty, together with date and proof of purchase of the
Product, proof of the costs of the original installation and name and address of all installers,
failing which this Limited Warranty shall be of no legal effect. Fin Pan, Inc. reserves the right at
its election and as a condition of this Limited Warranty to inspect the alleged failed and defection
condition.
