DefiningtheWarranty
NKSDesignsproudlyprovidedyou,theoriginalretailpurchaserofthe
giftrecipient,withthelimitedwarrantiesonyourNKSDesignsproduct
describedherein.Thesewarrantiesapplytotheproductspurchased
from theHomeDepot.comorNKSDesigns,andapplyonlyunder
normalconditions,indoor,residentialuse,unlesstheitemisspecifically
designatedassuitableforoutdoororcommercialuse,subjecttocertain
limitationsandexclusions.Ourresidentialproductsarenotdesignedfor
commercialsettings.
WarrantyLimitationsandExclusions
Becauseofthenaturalvariationsinwoodandthehand-finishing
techniquesusedtocreatemanyoftheNKSDesignsproducts,finish
colorsmayvarypiecetopiece.Thesewarrantiesdonotcoversuch
variationsoranydifferencebetweenswatches,orprintedillustrations
andyouritem(s).NKSDesignsisalsonotresponsibleforcolor
variationsinwood,fabric,leather,ordyelotvariationsthatmayormay
notoccurwithnonconcurrentorders.Thesewarrantiesdonotcover
productssold"asis"purchasedfromasourceotherthananauthorized
NKSDesignsretailer,usedinacommercialornonresidentialsettingor
shippedoutsidethecontiguousUSbyyouorafreightforwarder.Any
productmodificationbyretailerorconsumer,oruseofnon-NKS
Designsparts,voidsthiswarranty.
Theremediesprovidedinthisdocumentareexclusiveand,totheextent
allowedbyapplicablelaw,areInlieuofallotherremedies,warrantiesor
representations,express,impliedorstatutory,includingbutnotlimitedto
anyimpliedwarrantyofmerchantabilityorfitnessforaparticular
purposeandallotherobligationsandliabilities,whetherincontractor
tort,allofwhichareexpresslydisclaimedherein.InnoeventshallNKS
Designsbeliableforspecial,consequential,incidentalorotherdamages.
